Ruhi Sethi-Smith reports on Santander UK Plc v CCP Graduate School Limited

Ruhi Sethi-Smith of Forum Chambers reports on Santander UK Plc v CCP Graduate School Limited [2025] EWHC 667 for the Journal of International Banking and Financial Law. The decision overturned Master Brown’s first instance decision which in effect held that the retrieval duty can operate between the customer and their own bank but not between a victim of APP fraud and a receiving bank. This is the first time that the retrieval duty has been considered by the court. 

The report examines the facts of the case and considers the future impact of the decision on victims of APP fraud.
